1. Agreement to Terms
These Terms of Service ("Terms") are a legally binding agreement between you ("User", "you", or "your") and SavantX Technologies Pvt Ltd ("SavantX", "we", "us", or "our") governing your access to and use of the VidyaSetu website, portal, examination platform, and related services (collectively, the "Services").
By accessing or using the Services, you agree to these Terms. If you accept on behalf of a school, college, university, board, or other organisation, you represent that you have authority to bind that entity.
2. Eligibility
Institutional administrators and staff must have legal authority to act for their organisation. Students and exam candidates must use the Services only as directed by their institution and must provide accurate registration and identity information. Where a minimum age applies under local law or institutional rules, you confirm that you meet that requirement or have parental/guardian consent as required.
3. Services Description
VidyaSetu is an online examination management platform that may include, without limitation:
- Exam creation, scheduling, slots, and candidate registration (including olympiad / public registration flows)
- Online exam delivery, system checks, and attempt management
- Optional live / remote proctoring and integrity monitoring
- Results, marksheets, answer sheets, and ceremonial certificates
- Institution admin, invigilator, and student portals
- Payment collection for registration fees where enabled by the institution
We may modify, suspend, or discontinue parts of the Services with reasonable notice where practicable.
4. Accounts and Access
- You are responsible for keeping login credentials confidential
- You must notify us promptly of any suspected unauthorised access
- You are responsible for activity under your account
- We may suspend or terminate accounts that violate these Terms or pose a security risk
- Some features require an institutional subscription or separate commercial agreement
5. Acceptable Use
You agree not to use the Services to:
- Violate applicable laws, institutional exam rules, or academic integrity policies
- Cheat, impersonate another candidate, or subvert proctoring / integrity controls
- Share exam content, answer keys, or credentials without authorisation
- Infringe intellectual property rights of SavantX, institutions, or third parties
- Transmit malware or attempt unauthorised access to systems or data
- Reverse engineer, scrape, or disrupt the platform
- Resell or sublicense the Services without prior written consent
- Upload unlawful, harmful, or deceptive content
6. Intellectual Property
The Services—including software, designs, documentation, trademarks, and branding—are owned by SavantX or its licensors. "VidyaSetu" and related marks are associated with SavantX Technologies Pvt Ltd.
- No rights are granted except as expressly stated in these Terms or a separate agreement
- Institutions retain ownership of their exam content, branding assets, and institutional data they upload
- Candidates retain rights in personal information they provide, subject to our Privacy Policy and institutional instructions
- You grant SavantX a limited licence to process content and data solely to operate and improve the Services
7. Candidate Data, Exams, and Privacy
Use of the Services is also governed by our Privacy Policy.
- Institutions are responsible for lawful collection of candidate data and obtaining required consents
- Exam photos, proctoring signals, and results may be processed for identity, integrity, and assessment purposes
- We apply industry-standard security measures; see the Privacy Policy for details
- We do not sell personal data
8. Registrations and Payments
- Where fees apply, amounts and refunds are set by the organising institution or the applicable order form
- Payment gateways are provided by third parties; failed or abandoned payments leave registration pending until completed
- Slot assignment, admit instructions, and result timelines are controlled by the institution
- Platform subscription fees for institutions are as set out in the commercial proposal or agreement
9. Availability and Support
We aim for high availability, especially during scheduled exam windows. Specific uptime and support commitments for enterprise clients are defined in the applicable Service Level Agreement (SLA). Temporary unavailability may occur due to maintenance, force majeure, or factors beyond our reasonable control.
10. Confidentiality
Each party must protect the other's confidential information and use it only for purposes of these Terms, except for information that is public, independently developed, lawfully received from a third party, or required to be disclosed by law.
11. Warranties and Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAVANTX DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation. Automated integrity signals and AI-assisted features (if any) are advisory aids for institutions and should be reviewed by authorised staff.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- SavantX's total liability shall not exceed the fees paid to SavantX for the Services in the twelve (12) months preceding the claim
- SavantX is not liable for indirect, incidental, consequential, special, or punitive damages
- SavantX is not liable for lost profits, data loss, exam postponement caused by client-side issues, or reputational harm
13. Indemnification
You agree to indemnify and hold harmless SavantX and its officers, employees, and agents from claims arising out of your misuse of the Services, violation of law, exam content you provide, or candidate data you instruct us to process.
14. Termination
- Either party may terminate institutional access as set out in the commercial agreement, or with reasonable written notice where none applies
- We may suspend or terminate immediately for material breach, security risk, or non-payment
- Upon termination, access ends; we may allow a reasonable period to export institutional data where contractually agreed
15. Governing Law
These Terms are governed by the laws of India. Courts at Mohali / Chandigarh, Punjab shall have exclusive jurisdiction, unless a signed enterprise agreement specifies otherwise. Parties should attempt good-faith resolution before formal proceedings.
16. Changes
We may update these Terms from time to time. Material changes will be posted on this page and, where appropriate, communicated to institutional contacts. Continued use after changes take effect constitutes acceptance.
